Lost my rifle Certificate of Eligibility!

I lost my rifle Certificate of Eligibility. What should I do in this case? The rifle was bought in Dick's Sporting Goods in Freehold 4 yrs. ago. I contact the store to check if they have a copy, they have no idea what to do.

Apply for a new card. It cannot be used without a second picture ID anyway not that big a deal.

Are you talking about your FPID? or the certificate of eligibility you completed when you purchased your gun?

If its the later-so what-you can actually toss your copy of that in the trash as soon as you walk out the door. If its your FPID on the oterhand, you'll have to go back to your local PD and get another-that will take some time

When i buy a gun the certificate of eligibility get put in the garbage where it belong. As for your FID what i did was went to office max and have them make a copy you wont be able to tell the to a part thumb print and all they even laminate it. I put the origanal in the safe and use the copy to buy and cary

First, why was is it taken / What were the circumstances ? If they are just keeping it without any good reason, then contact the county prossecutor's office immediately and file a theft of firearm against the PD who is illegall keeping your property from you. That should get thier attention real quick.

I’m talking about certificate of eligibility not Firearm ID. My gun has been taken by Police and in addition to FID, they require the certificate of eligibility in order to get it back.
They may be asking for it as additional proof of ownership-but its not necessary-If you own the gun, and they took it from your (for whatever reason), and you are now eligible to possess it, they have to give it back. If they refuse-get an attorney, go to Court and file a "Writ of Replivin-" They will return it-and pay your attorneys fees

Dicks won't be able to produce a copy because it is not legal for them to retain those records.
They must retain it ...

Certificate of Eligibility said:
White copy is to be retained by the transferor pursuant to N.J.S.A. 2C:58-3b.
Yellow copy is to be retained by the receiver.
If internet form, make and sign two copies.
I keep all my Certificates of Eligibility.

WHY
because ....

-Living in NJ, I am very careful with all my fireams dealings. I've always fought for my rights by letters and meetings with legislators. I just don't want to get involved with any firearms bs with some local police department, etc. I pick my battles.

-The state required me to complete and sign this form that has mucho pertinent info on it, and they provided me a copy for my records. This is just one of the forms in life that I hold on to.

-It says to keep it on the bottom of the form.

That's not true. NICS check information will expire but BATF requires dealers to retain information.
Thats true... a number of years ago, there was a sport shop (that I would rather not mention) that lost the paperwork on 2 guns out of 10,000 (literally). Nappen represented them but they lost the court battle and lost their FFL. They are now under new management and with a new FFL.

Dicks probably has it, but they ain gonna dig thru 4 years of paperwork to find it. They want to prove the gun is yours all they have to do is run the serial number, see if it comes up as stolen.
On FFL paperwork, and certificates, I keep all copies that are to be kept by seller, including certificate of eligibility.

And there it is... they need to prove it's not yours or they must give it back. If you had a tv stolen would they make you produce the receipt to get that back if it was recovered? You're not a criminal just becuase youre a firearm owner. Get a lawyer and keep us posted on how this goes. Good luck getting it resolved.[up][up]
