Where is the page that pertains to taking them during permitted deer seasons? This page is irrelevant, one has nothing to do with the other. Deer hunting rules apply to taking them incidentally while deer hunting. Or just tell me which co told you know 6' from your face.

Yes you can take them incidental , if you are not elevated over bait ... That's is why the baiting regs were written like they are this year...
This very issue is one of the rule changes the NJ predator hunters club is pushing to change . That's why they had 2 COs in there meeting, to get clarification..

"Pursuant to NJSA 23:4-24.2, no person shall kill,destroy, injure, shoot, shoot at, take, wound, orattempt to take, kill or wound a game bird or gameanimal, or have in possession or control any firearmor other weapon of any kind, while elevated in astanding tree, or in a structure of any kind within300 feet of a baited area."

excecpt when hunting deer ??? Show me in the book where it says that cause I can show you several pages where it says you can't...

I think they mean specifically baiting for them.
if you get cited for that any judge will throw that out after looking at the regulations.

That's a good point but the state doesn't define bait like that .. Bait is bait .. I'm almost positive it was Frank Virgilio ( a retired nJ game warden) that explain that exact argument .

I tapped out because I have trouble dealing with people like you. You're the kind of guy that unbuckles and warms up the oil when you think you're going to have a keyboard pissing match. I don't want to be a part of that. I've emailed the division and will post the reply when I receive it.
