As per 2017 regulations:

"Pursuant to NJSA 23:4-24.2, no person shall kill, destroy, injure, shoot, shoot at, take, wound, orattempt to take, kill or wound a game bird or gameanimal, or have in possession or control any firearmor other weapon of any kind, while elevated in astanding tree, or in a structure of any kind within300 feet of a baited area."

I am not a baiter, but how long has this 300ft within bait rule been law? Most people I know who bait do it right under their tree stand.

"Pursuant to NJSA 23:4-24.4, the above restrictiondoes NOT apply to deer hunting. Hunterstargeting deer while elevated in a standing treeor in a structure of any kind may be within anydistance of a baited area."

nevermind, just saw this in the continuation of that section

The law does not apply to hunter seeking deer ALL other species are covered, including bears! Don't bet on LE enforcing that law though.

If you can hunt deer over bait, then you CAN take fox and coyotes incidental to your legally baited deer hunting, during permitted seasons. That is what "incidental" implies. Ask any co
No you can not ... This is an issue that nj predator Hunter club got clarification on earlier this year . The club pushed to have this published in the digest to help explain it to hunter as well.

Rdf is right. You can't hunt yotes or fox over bait Incidentle does not mean the rules change for them.

This is why I don't respond to these kind of post. You pass on them, I'll keep hammering them when they come in, bait or no bait. My advice to anyone in doubt, is to not take my word, or RDF's word. Ask the division yourself.

Small game season, Fox and coyotes may be taken when incidental to deer hunting during permitted seasons. It does not say unless over bait. This specifically pertains to taking them during deer season, while deer hunting. This is different than fox and coyote small game seasons, when one would be targeting these species, and baiting for them would be illegal.

It would be better if you didn't respond. There is zero reason to take anybody's word since it's written clear enough for a 10 year old in the digest .

Well, I certainly appreciate your resorting to insults. I agree it is written quite clearly, as it has been for years. Obviously reading comprehension is not one of your strong points. You can choose to interpret rules for one season, and apply them to another.

Argue all you want , you are wrong. It's 100% illegal to shoot any animal over bait while elevate besides deer. It says it right there.. No where does it say that over bait and elevated is allowed during special permit ..
