I was told by the owner of a hunting/fishing store that wooded lots that are unposted are open for anyone to hunt.

I told him that would be considered tresspassing as you don't have permission from the land owner to be there.

He said, "If it's not posted, you can hunt it."

I know I read on here that to legally hunt any private NJ land you must have permission from the land owner.


Who's right?

stronski dude whoever told u that is wrong,,,,,in NJ the landowner dont have to post his property if he chooses not too...its the hunters job to find out if its private or public land,,,,,you hunt it and get caught you WILL be charged with trespassing,,,,,so get the address and go to town hall and they will tell you who owns it

Unfortunately alot of hunters actually believe this. I have several parcels that my family owns and are not posted. I haven't hunted them yet because I don't have the time to get out there and post them. Others do hunt them (without permission). I choose not to chase anyone off until it's posted. When I finally do post, you bet I'll be there.

I knew I was right. This old timer tried to convince me otherwise. Maybe he thinks an agricultural land is not a wooded area.
 
Funny how the game laws don't specify that you need written or oral permission to enter unposted non agricultural lands. But if its posted or agricultural land you better have permission. Seems to imply its OK on nonposted non agricultural land, bring your lawyer with you.

Yes it does seem to imply this though I would never hunt land that I didnt have permission to hunt. Just ask for permission...it isnt that hard....better to be on the safe side than going around pissing off land owners by hunting without permission
 
Game warden told my friend yesterday that if the land was not posted and someone came on it that all he can do is ask him to leave am I missing something about all the written permission thing that has been a law for years
 
The way it works is if it is not posted and you get caught hunting it they have to tell you to leave and not come back since it was not marked. So the fort time you get caught you can not be charged with anything but don't go back or you will get a nivw set of bracelets to wear. But all they have to say to charge you is that they have caught you before even if they haven't and you are screwed
 
That is bullshit dave if you call the police you can have them arrested.So by your theroy if you go out shoping and leave your house i can use it and when you come home you have to tell me to leave first?You pay taxes and your land is your land plain and simple.Do you have to post your backyard?what if the neighbor decided to come over and use your grill and have a picnic?this is a matter for the police not a CO.If someone is on your land without permision call the police not a game warden.
