So, like many hunters, I use a trailer hitch cargo rack on the back of my jeep during hunting season. My rack stays on the entire season and is still on now. A woman in my neighborhood just knocked on my door and asked for my insurance info and told me that she will sue me if I don't provide it. Apparently, yesterday morning she was pulling out of the parallel parking spot behind me and drove forwards, her bumper must have caught the rack and she hit it hard enough to get stuck, when she backed up it took part of her front bumper off. She says I am at fault because I don't have a flag or anything attached to the rack and that is illegal to leave the rack on the jeep like that. There's no way I'm at fault here is there? Isn't it the drivers responsibility before they get in the car to make sure they have enough clearance to get out.
 
Call your insurance company and tell them what happened. Let them deal with it. That's why you have insurance.
 
screw her man... you should get a police report for HER HITTING YOU!!!! If there is any damage at all to your vehicle, call the police and have them write up a report. I dont care how minor it is, GET THE REPORT. That is the important part... you need that report before you can do anything with insurance.

I put reflective white/red tape on mine to make it more visible. It did not stop someone from hitting it in a taco bell parking lot. The lady asked me if I wanted any hot sauce, then BANG. I proceeded to get outta the car... shes like "SIR YOU CANT GET OUT OF THE CAR!!!" I'm like, "watch me".... then had a 10 minute screaming match with a guy and his girlfriend about tailgating people. No real damage so I didnt call the police, but it basically ended with "if you want to continue this argument I can call the police."
 
Don't know the legallity of it, but check your truck out and make sure the frame isn't screwed up. I got rear ended , and the guys car pushed my hitch down, and bent my rear frame. Very expensive fix since the whole back of the car had to be taken off.
 
not true!!! No police report has to be created. Its up to the owners of the vehicles if you want one. Seeing as though your vehicle was hit while parked, I STRONGLY SUGGEST you get a police report. Call up the non-emergency number, have them send out a cruiser, explain what happened, and ask the officer to write up a report. Its no problem... just dont let the officer talk you out of having them write one up. They may try to tell you that its under like $1000 in damage or some BS. Just tell them "I want a report".

Once you call that in, call your insurance company and tell them your vehicle was hit while parked and you already called the police department and had them write up a report. If you have the other ladys info that helps, but the police will put that on the report.

Worst case scenario here is you get a check to repair/replace any damage on your vehicle. Its not going to go against your insurance rates seeing as though your car was hit while parked. I dont care if a portable rodeo sex machine was attached to your hitch, this witch still crashed her beater into it. ITS HER FAULT, 100%

LOL... yes a Scion hunting vehicle sporting Metallica license plates. HAHAH [rofl]
 
Most insurances want a police report. If she didn't get it when it happened, no way for her to prove it happened with your car. For all you know, she could have damaged her car somewhere else and pins it on you.
