Heard on the news this morning. NY State Senate and Legislature each are in agreement with Cuomo's mandate that all firearms sales must include a background check. Thus it WILL be the law in NY very shortly. Since you and I as non-dealers, don't have access to NICS, the resulting law will likley mandate every transaction to go through a state licensed dealer (much like we in NJ have to do when buying from out of State). That'll cost the buyer/seller another $50.00 per firearm, slow down the process, and allow the state to create a data base of transactions showing who owns what.[wallmad]
 
Other than the cost, I don't see a problem.
On a positive note, gun shops will see a marked increase in business. That's the reason it's goin through so easily.

I have no problem with requiring background checks.

I DO have a problem if the only way to do so is through an FFL. Why can't they open NICS to individuals and require that a confirmation number be listed on the Certificate of Eligibility?

So, how's this going to work? Two people who live in the vast state of NY have to find a mutually convenient FFL that charges reasonable fees. They have to take time off of work to meet there during business hours. Then, with the permanent increase in background check volume, they have to pray that the check goes through, and if it doesn't....go back to step one.

The only good I see coming out of this is that a lot more people may find it profitable to become FFLs, so we'll end up with a lot more Jim Flynn type operations with low fees. Another unintended consequence of well-intentioned legislation.
 
I am more concerned about the proposed legislation in our own Assembly that gun buyers have to undergo a psychiatric evaluation to purchase a firearm. That proposal would effectively shut down firearms sales, period, as the logistics,( how may psychiatrists do we have in Jersey) and who can afford the evaluation at $150 an hour? iiam becoming much more alarmed by the proposals coming out of our state legislatures than our federal government.
 
In todays day of technology, running a NICS check should be no more complicated than us checking in a deer.
Log onto a site, enter buyers info, get a confirmation #. Log it onto transaction paperwork. That would protect the seller too. Simple FREE solution that should make everyone happy except for criminals.
I've never sold a gun before, but would like to know I'm doing it responsibly, beyond what would currently be legally. Currently, I would only sell a gun to a friend or someone I knew well who I know is responsible.
 
New York does not charge purchasers a NICS fee. However, if you fail a background check while purchasing a firearm, some may assess you a fee.

This new proposal is simply another knee-jerk reaction to a non-issue. This is another example of the slippery slope if folks agree with this.

What's next:
NICS check to buy more than 100 rounds of ammunition? Then:
........a NICS check to buy ammunition?
........a NICS check to join a gun club?
........a NICS check to shoot at the local sporting clays range?

In NY, many big box sporting goods stores now require you to have a NY pistol license in order to purchase 'handgun' ammunition. As a non-resident, since you don't have a NY pistol license, you can't buy loaded handgun ammo.

Where does it end? As they say, if someone farts in New York, New Jersey smells it. We are two peas in a pod at times.
 
This is not going to prevent jack from happening. All this does is force people to report a sale to the state. It is not the state or anyone else's G#$ D%mm buisness what I buy or sell.

They could do that in NJ, you call a 900 number to get your NICS check now, just open that number up to the general public, and add one or two questions about the seller. State still gets their money, you have your freedom.
