To get metaphysical on you - it's only illegal when you get caught doing it (and you aren't a politician or close kin thereof).
 
if a squirrel is causing damage then it can be controlled. a list of animals that can be controlled lethally with out a permit is in the digest under wildlife damage control. (I think it is page 26)(or do a search in our field of wildlife control procedures) you can control damage causing wildlife in this list by lawful procedures at any time. Now you can't shoot with a air rifle (Not acceptable means) Nor can you shoot with in 450 of another dwelling with out written permission. or discharge a firearm with in city limits. and if some one reports you, you better have proof that there is damage and you are addressing these damage causing animals not just random Or be out in the middle of the woods with no crops that is being damaged[hihi] have seen guys get nailed hard on that that is out of season hunting.,( better hope fish and Game is called and not spca.)

Relocation IS allowed for squirrels you can find that in the NJ relocation policy (really fun and enjoyable reading[hihi]) but must be on private property with permission and with in the county of the capture site.
 
Rat trap tacked to a tree with peanut butter. After about a week there will be significantly less squirrels.
