A employee of mine got into a fight(argument) with another employee. "Hey nothing wrong with a good old fashion yelling match" As a owner I did what was right. I aproched the altercation area and told them to knock it off and they could settle it later after work. Needless to say this was in front of my customers. I had asked them to not do something like this in front of people that are PAYING to come to my place.
THIS IS WHERE IT GETS UGLY>
The worker told me to [email protected]# OFF and [email protected]# all your customers right in front of all of them. I told him in a stern voice to hit the road and don't look back.
The worker filed for unemployment and I appealed the filling and we had a voice appeal over the phone with a state worker.
THIS IS WHAT I GOT IN THE MAIL YESTERDAY
" In general a worker is expected to refrain from offensive language and behavior towards the Employer and his fellow workes. The use of profane ,violent,vulgar or threating language may constitute misconduct. (HOWEVER) to constitute misconduct.behavior must go beyond the ORINARY reaction of a reasonable person.
The claimants actions were not a wanton or willfull disregaurd of the employer's interest. As it did not effect his actual job discription.
OFFICE IN FAVOR OF THE CLAIMANT
aint that some shit !! He told me to [email protected]$ off and [email protected]# my customers but that wasn't a disrigaurd for me of my buisness.
So if you want to take the summer off just tell everyone to [email protected]# OFF and sit back and get checks in the mail.
