A employee of mine got into a fight(argument) with another employee. "Hey nothing wrong with a good old fashion yelling match" As a owner I did what was right. I aproched the altercation area and told them to knock it off and they could settle it later after work. Needless to say this was in front of my customers. I had asked them to not do something like this in front of people that are PAYING to come to my place.
THIS IS WHERE IT GETS UGLY> :( The worker told me to [email protected]# OFF and [email protected]# all your customers right in front of all of them. I told him in a stern voice to hit the road and don't look back.
The worker filed for unemployment and I appealed the filling and we had a voice appeal over the phone with a state worker.
THIS IS WHAT I GOT IN THE MAIL YESTERDAY

" In general a worker is expected to refrain from offensive language and behavior towards the Employer and his fellow workes. The use of profane ,violent,vulgar or threating language may constitute misconduct. (HOWEVER) to constitute misconduct.behavior must go beyond the ORINARY reaction of a reasonable person.
The claimants actions were not a wanton or willfull disregaurd of the employer's interest. As it did not effect his actual job discription.
OFFICE IN FAVOR OF THE CLAIMANT


aint that some shit !! He told me to [email protected]$ off and [email protected]# my customers but that wasn't a disrigaurd for me of my buisness.
So if you want to take the summer off just tell everyone to [email protected]# OFF and sit back and get checks in the mail.

SORRY GUYS JUST VENTING TODAY !!

Not everyone...as a business owner, you can't collect unemployment and neither can any immediate family members who work for you...but they still take a deduction out of your paychecks every week...I think that is bulls$$t too!

Take from those who work to give to those who don't...welcome to Socialism boys [down]

I thought they changed that where if someone is "fired for cause" they could not collect.

The worst that will happen to them is that they are penalized for 6 weeks... I don't bother fighting anymore either.

If working with unemployment doesn't work, file a complaint about how you were "verbally harrassed" and "subjected to terroristic threats".

Used NJ's f-ed up laws against this P.O.S., who has used them against you.

1) This a-hole gets locked up.
2) If he ever owned a gun, it is GONE.
3) It follows him.
4) It strengthens your reason to appeal the decision.

tartu88 that was after my appeal. That is what the final result of the appeal said when the letter came in the mail.

I understand everyone gets fustrated from time to time and all bosses need a reality check but to tell the customers to fu#@ off right in front of them should have been a good reason to be disqualified.
Every buisness needs every customer that that have at this time in the resesion that we are in. So I fugured that the State would have been in my favor. OOOH well ! That is the state for you and another person sitting home on his ass collecting checks for the next 72 months.
