My ex's father (we're on good terms) wants to give my son a 410 pump that's been in the family for about 60 years. He wants to keep it in the family for another generation. here's thr trick. He lives in FL. What's the rule for interstate gifts of firearms??

must be shipped to a licensed dealer, from a licensed dealer.  talk to terry at yoj sports in andover.  he can set you up.  he may bang you for $35 or whatever the nics fee is, maybe his fee?

I'm pretty sure his X father in law can ship it directly to a FFL in NJ... No need for a FFL in Fla....

Are you talking about your wife's gun that your father-in law gave her when she was 18?

Nope this .410 pump was owned by my son's great grandfather. My ex wife never owned it.

your relative can ship the gun by ups to an ffl dealer here in nj. that's all thats required. the ffl dealer here in nj will do a nics check plus charge you for his services.

I could be wrong but I would honestly think based on the age of the gun that there is no sales record there for it could have been bought here in New Jersey, and as long as it was never registered in any other state and you have your FID then I see no reason the gun can't be just transferred to you by hand in this state with a down loaded state trasfer form This is asumeing that the gun owner aka Great GrandPa was from New Jersey Originally

Wouldn't a gun that old be granfathered in as legaly owned  if it was given to said person say in 1969.

Ok, here's what I was getting at.  In most states (not NJ) private sales of firearms are not regulated between citizens of that state.  Meaning you can privately sell a firearm just like you sell any other object.  No receipts are even needed.

If your wife lived in one of these other states (FL for example) and the same state as her father then who is to say the "gift" did not happen then?
