NJ Hunter / New Jersey Small Game & Waterfowl Hunting / Small Game Action / Magazine Capacity

Question:  If you put 3 rounds of ammunition into a rifle to hunt woodchucks with, but the total magazine capacity holds more than 3 rounds, is this legal?  Again, there are only three rounds in the rifle, but total capacity exceeds 3 rounds.  I called fish and game and was given some attitude because the person apparently didn't understand my question at first.  They ended up saying it is legal however, but I would like to see the law in writing so any links would be appreciated.  Thanks.

If a shotgun must be plugged so as not to accept anymore than 3 shells total, It goes to reason the same for a rifle. pge 59 of the digest.

That's what's weird, because the person I got at F&W said a rifle did not need any kind of plug.  Very confusing.

i THINK you dont need a plug, as long as only 3 rounds are held at a time (including the one in the chamber).. BUT i believe is the magazine holds MORE than 10 rounds, you need to plug it to a max of 10. as long as only 2 out of the 10 in the magazine are loaded, i think your fine. (again, thats how i understood it 5 years ago, not sure how things changed since then)

You do not need to plug a rifle magazine woodchuck hunting.  Can only have 3 rounds in gun regardless of capacity.  Same holds true for trappers using a 22 for dispatch weapon.
