Hi. I've been told that I need to get a expungemnt of a police record before I can get my ID card to buy guns in NJ. Do you know how long it takes to do this? Will I hve time to get my ID card before December? Thanks alot. BB

sure you will. though not by december of this year, nor december of next year. you should be good by december of 2009 although I wouldnt count on it.

Depends on the county.....Bergen County does all expungements twice a year.....April and October, unless things have changed

They don't take that long, Depending on your record. I was expungged in 3 months. Your only allowed two charges to be expunged though.Anymore then that you might be in for a long haul

Just had one done ......started in april....was good by June........now only if i could find the time to get to PD for firearms ID application

I did my own back in 2005, without a lawyer.

When you actually file your papers with the court, they will immediately assign a "hearing" date, that must be within 35 to 60 days. On the hearing date, the judge will actually sign the Expungement Order and you'll get it the next day or two. Then, you mail a copy of that order to various law enforcement agencies who will seal their records of you.

Add up to 10 days for you to get your official NJ Criminal Record from the state police.

So, it can take from about 7 weeks up to 12 weeks.

Expungement is very simple. All done through the mail, usually. Good luck.

mine took 7 months with out a record so good luck some towns drag their heels detectives actuly canvas the area i live in and asked if they knew me and if they thaught their was any reason for me to not be abale to own a gun and this was more than 20 years ago its even harder now

I've heard six months to a year a lot of things facter into how fast things get done like information and records gathering. So hope for 6 but plan for at least a year then you wont be disapointed if it's done quicker.

Good People sometimes do stupid things, doesn’t mean they shouldn't be entitled to a second chance Most criminals don't worry about getting things expunged, as they have extensive records and know they will never be nothing but criminals. Best way is not to judge others let the system handle that.

I agree and in New Jersey I'm sure if there is any reason to turn a person down for an expungement and there FPIC they sure will.

All your time and probation complete ?

after lawyer and paperwork submitted does not take too long.

By December, highly doubtful.. especially with how long the state takes getting the ID card for a person with a squeaky clean record...

I come from a family of officers and retired politicians... My card took about 4 months..

The charges are only minor, but I'd really rather not say. Its stupid. They were a long time ago.

I was hoping to have a fireams ID by December so I could buy a gun for this hunting season. All my life, I've used borrowed guns, had my girlfriend buy me guns, etc. I just really want to be able to walk  into a gun shop and buy a gun like a normal person, I feel like a second-class-citizen now. But, if it does not happen for December, I'll live.

Both violations of the law and in a big way! You cannot borrow a gun from its owner for hunting unless you meet the legal requirements to obtain an FID card, and the owner is present in the vacinity.

Someone cannot buy a gun for you If she gets caught, thats a felony on her part for falsifying the purchase declaration where she certifies that she is the actual recipient of the gun and is not buying it for someone else.

Off to a bad start for expungement if these facts come up. Just some friendly advice, but Be carefull about what you say

Not any more. anything over 52 grams is a fellony with attemp to distribute.


Also, someone mentioned you can only get two in a lifetime. You may want to look into that again. I believe it's 1 and done.

FYI, If your drivers license was part of this penalty, you will have to contact the DMV and have it removed from there records.

Hi Brian. I'm still at work, sitting in a stupid presentation, so I'll give you details later.

I did mine with a booklet from New Jersey Legal Services (??). It has all the information, instructions, and all the forms.

I strongly suggest you get your criminal record now. It will contain all the info you need ..... the exact dates, statutes, dockets, penalties, etc that you need to complete the forms. You need to go to your local police department and get fingerprinted. They have the card that the prints will go on .... "State Applicant Card" ..... something like that. They may charge you to take your prints, and they may do it in the evenings. My local PD only did prints on Saturday and Sunday mornings, and they did not charge to do it. The reason you are getting the prints is "Individual Review/Dispute of Criminal Record" or something like that. You will mail those prints, and a form, to the state police with a money order for $30 (I think that is the price). You will get your rap sheep within 10 days.

So, get your prints done to get the ball rolling. I will post details tonight.
