OK, a buddy of mine just called me and asked me to be one of his references. I've known him since middle school, so I agreed.
He then posed a question regarding his application where it asks if you've ever been arrested. He was years ago in FL for toting Mary J around. Questions: 1) Should he report this arrest? i.e. be honest on the application, or is it one of those questions where he answers YES he is automatically declined? 2) Anything I should be aware of being a reference for him? Any help would be appreciated. |

| He better disclose the arrest, the posseession charge is only a DP offense, unless he was carrying a larger amount and charge with intent to distribute. The DP offense used to be under 50 grames. The fingerprint check to the state & feds will find his prints on file. Then he will most definitely be denied for lying on his application. | ||

Other states would not care about possession of a small amount of pot as a young man, but NJ does. He may need to have it expunged before he will get an NJ FID.
If he was fingerprinted, he has to put the arrest on his FID application. Maybe his local police chief (who will be deciding on his FID application) would tell him upfront if he needs to the expungement, and not waste the 2 or 3 or 4 months waiting for his application to be denied. Expungment is easy here in NJ .... it all could be done through the US mail usually ..... I would think that Florida would be just as easy. Good luck to your friend. |

I forget what exactly the application asks. If it was arrested for a FELONY, and your friend was charged with a Misdemeanor, then he can answer no.
But if he should answer yes, then definitely answer yes. Don't lie. |

| officer in my town told me when i asked, they would probably overlook it....as long as there were no other problems since then(it happened 30 years agoe). But then i told them i had applied for a FID card in the past and it was denied. They wouldnt do it with out an expungement after that. | ||
